Confidentiality, Privacy, and Data Sharing

To apply for or participate in the NXT Activate Accelerator Programme ("Programme"), you will be asked to provide certain personal and business information, which may include contact details, professional background, application materials, company information, pitch materials, and Programme participation records. This information is used to evaluate applications, select participants, deliver Programme services, facilitate mentoring, assess potential investment opportunities, and administer the Programme.

Artificial intelligence tools may be used to support the evaluation and administration of applications, including for initial screening, summarisation, or shortlisting. No application is rejected on the basis of automated processing alone; a member of the Programme's human selection committee reviews all applications, including those flagged by AI tools, before any selection decision is made.

The Programme is delivered by NXTDEV Advisors Ltd. and Bentley Systems, Incorporated (each acting as an independent data controller), together with authorised Programme sponsors, funders, mentors, judges, investors, and selection committee members (collectively, "Programme Partners"). Your information may be shared with Programme Partners where necessary for participant evaluation, mentoring, Programme administration, reporting, networking, and investment consideration. Where pitch materials or other commercially sensitive business information are shared with investors for the purpose of evaluating potential investment, such sharing is limited to what is reasonably necessary for that purpose. Certain third parties may also process information on our behalf as service providers, acting solely on instructions and subject to appropriate data protection agreements.

All personal data is handled confidentially and processed in accordance with applicable data protection and privacy laws. Access is limited to individuals with a legitimate need to know in connection with the Programme, and all such individuals are subject to appropriate confidentiality, security, and data protection obligations.

Participant information may be retained for the duration of the Programme and for a period thereafter as set out in the Programme's retention schedule, where necessary to:

  • administer, operate, and evaluate the Programme;
  • manage participant, mentor, investor, sponsor, and alumni relationships;
  • comply with legal, regulatory, accounting, and record-keeping requirements; and
  • assess, pursue, and manage potential investment and partnership opportunities arising from the Programme.

Where applicable, you may have rights regarding your personal data, including rights of access, correction, restriction, objection, portability, and deletion. Further detail on these rights, and on the legal bases and safeguards (including for any international transfers of personal data) applicable to processing under the Programme, is provided in the privacy statements referenced below.

Your information will not be sold to third parties. It will not be used for marketing purposes unrelated to the Programme unless you consent, or applicable law otherwise permits it. Bentley and NXTDEV Advisors Ltd. each maintain their own privacy statement. For information on how Bentley processes personal data, please refer to the Bentley Privacy Statement at https://www.bentley.com/legal/privacy-policy/. For information on how NXTDEV processes personal data, please refer to the NXTDEV Activate privacy notice at https://nxtactivate.com/privacy/. Both statements should be read together, alongside any Programme-specific privacy notices provided as part of the NXT Activate application and participation process.
